K-1 Visa - for Fiancé(e)s of U.S. Citizens
Who is eligible?
A fiancé(e) of a United States citizen who will travel to the United States to marry and take up indefinite residence after marriage. To qualify for a fiancé(e) visa, the following criteria must be meet:
- one party is a U.S. Citizen;
- both parties are legally free to marry; and
- the marriage will take place within 90 days of the fiancé(e) entering the United States on the fiancé(e) visa.
Applying for the visa
The first step in applying for a fiancé(e) visa is for the U.S. Citizen fiancé(e) (the petitioner) to file a petition on Form I-129F with the United States Citizenship and Immigration Services (USCIS) in the United Staters. Note: The petition can only be filed with the USCIS in the U.S.; it cannot be filed with the USCIS office in London.
Children
Children under the age of 21 are eligible to derive status from the fiancé(e) visa petition filed on behalf of their parent; their name(s) should be included in the petition. If the U.S. Citizen is the natural father of the child, the child may have claim to American citizenship and, therefore, may be eligible for a U.S. passport.

Below is a short youtube video that describes how to get your Fiancee Visa
-
Please note that your fiancee may enter the United States only one time with a fiancee visa. If your fiancee
leaves the country before you are married, your fiancee may not be allowed back into the United States without
a new visa.
If your new spouse will apply to become a legal permanent resident while in the U.S. but also plans to travel
outside the U.S. while the application is pending, see Have a Pending Immigration Application?.Beware of Foreign
Travel.
After arriving in the United States, your fiancee will be eligible to apply for a work permit. (You should note
that USCIS might not be able to process the work permit within the 90-day time limit for your marriage to take
place.) Your fiancee should use Form I-765 to apply for a work permit. Please see Obtaining a Work Permit for
more information. If your fiancee applies for adjustment to permanent resident status after the wedding, your
fiancee must re-apply for a new work permit.
Expert Tip # 4
Attach to the I-129F a typed letter describing in full detail the nature of your relationship with your Fiancee. Describe where and when you met, the situation, what happened, how the relationship developed, what are your plans when she arrives for the 90 days, what are your wedding arrangements, what are your long term plans for your future life together. A sample “Nature of Relationship” letter is shown at Fiancee Visa Secrets eBook. The more detail you provide the better. Couples planning a life together have long conversations and make detailed plans. Share these plans in your letter. This serves to confirm the sincerity of the relationship.
